We also collect, use and share aggregated data such as statistical or demographic data for any purpose. Identity verification and prevention of identity fraud during onboarding
Identification and verification data, including copies or scans of government-issued identity documents, photographs, selfies or short videos, and the results of liveness checks.
Biometric data, comprising facial geometry, biometric templates or other data generated through specific technical processing of those images and used to uniquely identify or verify you.
The processing is necessary to comply with our legal and regulatory obligations relating to identity verification, customer due diligence, anti-money laundering and the prevention of financial crime. Where the processing is not required by law, it is necessary for our legitimate interests in preventing and detecting identity fraud.

Where we process biometric data to uniquely identify or verify you, we rely on the substantial public interest condition under the UK GDPR.
Anti-money laundering and fraud-prevention checks
Personal data relating to criminal convictions and offences, including relevant information concerning criminal allegations, proceedings or suspected criminal activity.
The processing is necessary to comply with our legal and regulatory obligations relating to anti-money laundering and the prevention of financial crime. Where the processing is not required by law, it is necessary for our legitimate interests in preventing and detecting fraud and other unlawful activity.
ADDITIONAL CONDITION
We process criminal offence data for the prevention or detection of unlawful acts and compliance with regulatory requirements relating to unlawful acts and dishonest under the UK GDPR.
We disclose personal data to: legal and regulatory authorities; our external advisors; our processors; our third party service providers to whom we have delegated certain activities, including credit reference agencies; any party as necessary in connection with legal proceedings; any party as necessary for investigating, detecting or preventing criminal offences; any purchaser of our business; and any third party providers of advertising, plugins or content used on our websites or app.
In order to provide payment services we need to send your data to certain trusted third-party companies who provide essential payment system and payment processing services, including participants in Faster Payments and Bacs.
We may also send your data to third-party service providers to whom we have delegated certain activities e.g., cloud service providers, fraud prevention and detection partners, credit reference agencies (see paragraph below for more information), KYC (know your customer) service providers, companies that produce debit cards, card producers and networks like Mastercard, third party app platforms like Google and Apple and our AI-assisted support system, Gradient Labs. We are fully responsible for the processing of your personal data by these service providers. Your personal data will only be shared with third parties for the purposes set out in this privacy policy. We do not permit Gradient Labs or its subprocessors to use your personal data to train general AI models or models used for other customers.
If we engage a third party processor to process your personal data, the processor will be subject to binding contractual obligations to: (i) only process the personal data in accordance with our prior written instructions; and (ii) use measures to protect the confidentiality and security of the personal data; together with any additional requirements under applicable law.
Together with the Society of Worldwide Interbank Financial Telecommunication (SWIFT) we act as joint controllers in respect of the payments messaging service provided by SWIFT, meaning that we have jointly determined the purpose and measures of this data processing. Credit Reference Agencies
Where we share personal data with credit reference agencies, each agency may process that data as an independent controller for its own purposes. Their processing is governed by their own privacy information, including the Credit Reference Agency Information Notice (CRAIN), available here. This link may be updated from time to time, so please refer to the most recent version available on the credit reference agency’s website. LHV remains responsible for its own collection, use and disclosure of personal data, but is not responsible for processing undertaken independently by a credit reference agency.
Fraud Prevention Agencies
The personal information we have collected from you will be shared with Fraud Prevention Agencies who will use it to prevent fraud and money-laundering and to verify your identity. If fraud is detected, you could be refused certain services, finance, or employment. Fraud Prevention Agency Policy
General
1. Before we provide services, goods or financing to you, we undertake checks for the purposes of preventing fraud and money laundering, and to verify your identity. These checks require us to process personal data about you.
2. The personal data you have provided, we have collected from you, or we have received from third parties will be used to prevent fraud and money laundering, and to verify your identity.
3. Details of the personal information that will be processed include, for example: name, address, date of birth and contact details.
4. We and fraud prevention agencies may also enable law enforcement agencies to access and use your personal data to detect, investigate and prevent crime.
5. We process your personal data on the basis that we have a legitimate interest in preventing fraud and money laundering, and to verify identity, in order to protect our business and to comply with laws that apply to us. Such processing is also a contractual requirement of the services or financing you have requested.
6. Fraud prevention agencies can hold your personal data for different periods of time, and if you are considered to pose a fraud or money laundering risk, your data can be held for up to six years.
Automated Decisions
As part of the processing of your personal data, decisions may be made by automated means. This means we may automatically decide that you pose a fraud or money laundering risk if our processing reveals your behaviour to be consistent with money laundering or known fraudulent conduct, or is inconsistent with your previous submissions, or you appear to have deliberately hidden your true identity. You have rights in relation to automated decision making: if you want to know more please contact us using the details in Section 2 above.
Consequences of Processing
7. If we, or a fraud prevention agency, determine that you pose a fraud or money laundering risk, we may refuse to provide the services or financing you have requested, or to employ you, or we may stop providing existing services to you.
8. A record of any fraud or money laundering risk will be retained by the fraud prevention agencies, and may result in others refusing to provide services, financing or employment to you. If you have any questions about this, please contact us on the details in Section 2 above.
Data Transfers
9. Fraud prevention agencies may allow the transfer of your personal data outside of the UK. This may be to a country where the UK Government has decided that your data will be protected to UK standards, but if the transfer is to another type of country, then the fraud prevention agencies will ensure your data continues to be protected by ensuring appropriate safeguards are in place.

10. Your personal data is protected by legal rights, which include your rights to object to our processing of your personal data, request that your personal data is erased or corrected, and request access to your personal data.

Transaction monitoring for suspicious/fraudulent activity
Examples of the measures we use include:

· Staff training to ensure all personnel understand their responsibilities in protecting personal data;
· Anti-virus software to safeguard against malware and other digital threats;
· Password protection for systems access to restrict entry to authorised users only; and
· Encryption of sensitive data where possible to enhance its security during storage or transmission.
Because the internet is an open system, the transmission of information via the internet is not completely secure. Although we will implement all reasonable measures to protect your personal data, we cannot guarantee the security of your data transmitted to us using the internet – any such transmission is at your own risk and you are responsible for ensuring that any personal data that you send to us are sent securely.
Where we have given you (or where you have chosen) a password which enables you to access your online account or app, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.
We take every reasonable step to ensure that your personal data are kept accurate and up-to-date and are erased or rectified if we become aware of inaccuracies.

We take every reasonable step to ensure that your personal data is only processed for the minimum period necessary for the purposes set out in this privacy policy. The following retention periods apply:
Active customers: correspondence relating to retail banking and information captured as part of KYC / CDD checks is retained for six (6) years after the end of the customer relationship.
Declined applications: personal data relating to declined applications is retained for six (6) years after the date on which the application is declined.
Pre-onboarding (where the onboarding journey has been partially completed but the application has not been submitted): personal data is retained for six (6) years after the application is abandoned.
In all cases, we may retain your personal data for longer periods where necessary for the establishment, exercise or defence of legal claims, or where required by applicable law or regulation.
As a general rule we retain your data in a form that permits identification only for as long as we maintain an ongoing relationship with you, or as necessary in connection with the lawful purposes set out in this privacy policy for which we have a valid legal basis, and in each case, until the end of a limitation period of possible claims (including any additional periods as are necessary in connection with that claim).
During the periods relating to applicable limitation period under applicable law, we will restrict our processing of your personal data to storage of, and maintaining the security of, those data, except to the extent that those data need to be reviewed in connection with any legal claim, or any obligation under applicable law.
Once the applicable retention periods described above is concluded, we will either permanently delete or destroy the relevant personal data, or anonymize the relevant personal data.
Artificial intelligence, Automated decision-making and profiling
Where relevant to the purposes described in this privacy policy, we may use approved artificial intelligence-assisted tools to process your personal data in carrying out our day-to-day business activities and providing products and services to you. These tools may assist our staff with reviewing, analysing, drafting and summarising information and communications, carrying out legal and compliance functions, managing risk, preventing and detecting fraud, improving our products and services, and supporting customer service. Some of these tools may use generative artificial intelligence.
We also use an artificial intelligence-assisted customer support tool to review and triage incoming customer queries. It may respond directly to general queries and will route account-specific queries, or queries requiring further investigation or human judgement, to a member of our customer support team.
We apply safeguards appropriate to the nature and risks of each use of artificial intelligence. Depending on the relevant use, these safeguards may include data minimisation, testing for accuracy, performance and bias, access controls, security and contractual measures, human review or oversight, monitoring and periodic review. LHV remains responsible for its use of artificial intelligence-assisted tools and for decisions made using their outputs.
Where we make a decision about you based solely on automated processing that has a legal or similarly significant effect on you, we will provide you with information about the decision and enable you to make representations, challenge the decision and obtain human intervention, as required by applicable law.
Profiling
Profiling means the automated processing of your personal data to evaluate or predict certain aspects relating to you, such as your economic situation, transaction activity, behaviour, preferences or risk profile. We may use profiling for the purposes described in this privacy policy, including to provide our services, manage risk, prevent and detect fraud, and comply with our legal and regulatory obligations.
We use data, analytics, automation, and advanced analytical techniques, including artificial intelligence (AI) and data science, to deliver, operate and improve our products and services, manage risk, prevent fraud and financial crime, and improve efficiency.
Some of these activities involve profiling and automated processing. Where decisions may have a legal or similarly significant effect on an individual, we apply appropriate safeguards in line with applicable data protection law. Where required, this includes meaningful human review and the ability for individuals to exercise their rights.
Profiling – how we use data
Profiling is automated processing of personal data to evaluate certain personal aspects relating to an individual, for example to analyse or predict behaviour, location, movements, economic situation, personal preferences or interests.
We use profiling in our anti-money laundering and fraud screening and monitoring processes. This helps us comply with legal and regulatory obligations relating to anti-money laundering, sanctions, fraud prevention and payment security. Profiling may also be used in negative news screening for anti-money laundering and reputational risk management purposes.
The profiling we carry out may contribute to a decision that a payment transaction cannot proceed or that we cannot provide a service. Where a decision has legal or similarly significant effects, we do not rely solely on automated processing unless permitted by law and subject to the safeguards required by applicable data protection law.
AI, data science and automation – how we use data
We use data, analytics, automation and advanced analytical techniques, including AI and data science, to support service delivery, risk management, fraud prevention, operational resilience and efficiency.
We are committed to the fair and responsible use of these technologies. This includes taking reasonable steps to test for bias and performance issues, applying appropriate governance and human oversight, and implementing proportionate security and control measures.
We may also use personal data, where necessary and permitted by law, to develop, test, validate, monitor and improve analytical models and AI-enabled tools used for our business purposes. We do this subject to appropriate governance, contractual controls, data minimisation and security measures. We do not permit third-party providers to use our customers’ personal data for their own independent model training unless we have specifically told you otherwise.
